Except as otherwise set forth on this site or within any physical products, including without limitation the product descriptions of the specific products, this site, and the products offered for sale on it and the transactions conducted through it are provided by us (“Garden Cruisers”) on an “as is” basis. We make no representations or warranties of any kind expressed or implied, as to the operation of the site or the information, content, materials, or products we offered. Except for any warranties that are expressly provided. To the full extent permissible by applicable law, we disclaim all warranties, expressed or implied, including, but not limited to implied warranties of merchantability and fitness for a particular purpose, noninfringement, title, data accuracy and system integration and within any physical products. This site may include inaccuracies, mistakes or typographical errors. We do not warrant that the content will be uninterrupted or error free. In no event shall Garden Cruisers be liable to the customer for any damages of any kind arising from the use of its products, including, but not limited to personal injury, loss of life, or direct/indirect, incidental, punitive, exemplary, special, or consequential damages, or any damages whatsoever resulting from but not limited to misuse, neglect, loss of use, profits, or down-time (however caused and under any theory of liability, whether the basis of liability is breach of contract, tort (including negligence and strict liability), statue or any other legal theory), even if Garden Cruisers has been advised of the possibility of such damages. Garden Cruisers’ total liability to customer for any damages from all causes of action and under all theories of liability, shall not exceed the amounts paid to Garden Cruisers by customer.

TRANSFER OF OTHER WARRANTIES:

In the case of equipment and accessories not manufactured by Garden Cruisers, if a warranty is extended by the manufacturers thereof and transferable to Customer, Garden Cruisers shall transfer such warranty to Customer. It is the responsibility of the customer to submit the necessary documents/forms to register for said warranties in a timely manner.

EXCLUSIONS:

Garden Cruisers makes no warranty with respect to components that are covered by direct manufacturers’ warranty to the end user. These items may require registration with cards or online. Examples of this are: chassis, lighting, mechanical ventilation, electrical components, pumps, and any electronic items. Make all claims directly to the manufacturer of the defective item. This warranty exclusion includes any labor expenses involved with repairing or replacing any item or component. Warranty claims are subject to and must be made pursuant to, the terms and conditions, limitations and procedures specified by the manufacturer. Warranty claims must be made directly to the manufacturer and may require digital pictures or parts to be shipped to the manufacturer. Depending on manufacturer’s policy, some warranty claims may require payment for shipping costs associated with the delivery of the replacement parts. Customers are responsible for all costs of replacement parts and shipping costs for any claims covered or not covered by manufacturer warranty.

We make no claims as to the quality of the services or product(s) and its ability to assist in the growth or sustainability of vegetation. Garden Cruisers limited warranty provided herein does not cover: (i) normal wear and tear; (ii) transport damage; (iii) failure to follow assembly, operation, or maintenance instructions; (iv) Customer’s negligent and/or modification, disassembly or attempted repairs of the Product; (v) abuse, misuse or negligent acts; (vi) accidental or intentional damage; or (vii) cosmetic shortcomings which do not influence Product function. This includes loading in excess of gross item ratings and damages caused by acts of God.
