TERMS OF USE:

By using or purchasing any of the services or products provided by Garden Cruisers you acknowledge and agree to all of the following terms and conditions. You agree that the product(s) you purchase from Garden Cruisers are for your own use and not for resale unless explicitly authorized by Garden Cruisers in writing. Use of the products may be subject to local laws, regulations, and ordinances in your jurisdiction. It is the responsibility of the customer to comply with all applicable laws, regulations, and ordinances. By submitting an order request, placing an order, or providing Garden Cruisers with your contact information, you consent to receive certain electronic communications from us.

PLACING AN ORDER:

Customers may submit an order request via the website. Once an order request is submitted, Garden Cruisers will contact you directly using the contact information provided to review the order with you.

If desired, orders may be placed with a deposit amount equal to, at minimum, half of the total order price. The remaining balance plus shipping is due upon build completion. Completion dates are not guaranteed and are subject to change. When your ‘Cruiser’ is completed, you will be notified via email and the card on file will be charged the remaining balance plus shipping. The remaining balance and the cost of shipping must be paid prior to item release from our warehouse. Please refer to our Purchase Agreement for additional details.

CUSTOM ORDERS:

Custom designs are available upon request. Please add any relevant comments in your order request form to help us better understand your specific needs. Garden Cruisers will contact you directly to discuss your specific needs. If the request requires custom design, additional design fees may apply.

SHIPPING:

Shipping charges are based on the size and weight of the item(s) ordered, the shipping distance, the delivery destination’s access, and the chosen method of shipping. Unless otherwise requested, all ‘Cruisers’ will be shipped using third-party ground “Less-Than-Truckload” (LTL) shipping. Shipping cost will be based on the current market freight prices at the time shipping is scheduled. You will not be charged shipping until production is complete and the finalized shipping price is provided. Please refer to our Shipping Policy for additional details and available alternative delivery methods.

CANCELLATIONS, REFUNDS, AND SHOW MODELS:

Deposits are nonrefundable. Garden Cruisers are custom made to order, and sold “as is”. If an item must be cancelled, the ‘Cruiser’ will be built as scheduled. Once completed, it will be listed for sale as a ‘Show Model’. Once the ‘Show Model’ sells, we will refund the customer up to 75% of the original deposit (minus any transaction fees). MODIFICATION TO THE PRODUCTS, SERVICES, AND PRICING:

Notwithstanding any language in the limited warranty, Garden Cruisers shall have the right to discontinue the availability of any product(s) or components or upgrade parts therefore, and to make design changes or improvements in the products offered at any time. Such discontinuance or change shall not constitute a breach of warranty, or result in liability for Garden Cruisers under any legal theory whatsoever. Garden Cruisers shall have no obligation to retrofit, change or improve products purchased by the Customer prior to the discontinuance or change.

Prices for our products are based on current market value and subject to change without notice. Orders will not be adjusted to reflect sales, discounts, or price increases that may happen at a future date.

WARRANTY DISCLAIMER AND LIMITED LIABILITY:

Garden Cruisers and the products it offers are sold on an “as is” basis. In the case of equipment and accessories not manufactured by Garden Cruisers, if a warranty is extended by the manufacturers thereof and transferable to Customer, Garden Cruisers shall transfer such warranty to Customer. Garden Cruisers is not liable for any damages of any kind arising from the use of its services or products, including, but not limited to personal injury, loss of life, or direct/indirect, incidental, punitive, exemplary, special, or consequential damages, or any damages whatsoever. PRIVACY POLICY:

We collect information to provide better services to our users. We do not share personal information with companies, organizations, or individuals outside of Garden Cruisers unless one of the following circumstances applies: your consent, for external processing, or legal reasons. We may share non-personally identifiable information publicly and with our partners. If you have questions or concerns related to the collection or use of your data, please contact us.

USING OUR SERVICES, PRODUCTS, & INTELLECTUAL PROPERTY:

Don’t misuse our services. You may use our Services only as permitted by law, including applicable export and re-export control laws and regulations. We may suspend or stop providing our Services to you if you do not comply with our terms and policies or if we are investigating suspected misconduct.

Garden Cruisers owns intellectual property rights in its “Cruiser” products and website including but not limited to design, logos, slogans, trade names, and photos of the “Cruiser(s)”. Using our services does not give you ownership of any intellectual property rights in our Services or the content you access. You may not use content from our Services or the content you access. You may not use content from our Services unless you obtain permission from its owner or are otherwise permitted by law. These terms do not grant you the right to use any branding or logos used in our Services. Our services display some content that is not Garden Cruisers. This content is the sole responsibility of the entity that makes it available.

Garden Cruisers, design, logos, slogans, trade names or words are registered trademarks, trademarks, or service marks of Garden Cruisers. You may not use any of our trademarks or service marks in connection with any product or service in any way that is likely to cause confusion. You may not use our trademarks or service marks in any manner that disparages or discredits us. You may not use any of our trademarks or service marks in meta tags without prior explicit consent. In connection with your use of the Services, we may send you service announcements, administrative messages, or other information. You may opt out of some of those communications.

ARBITRATION:

You (the “customer”) and Garden Cruisers agree that every dispute arising in connection with these Terms will be resolved by binding arbitration. This agreement to arbitrate disputes includes all claims arising out of or relating to any aspect of these Terms, with the exception of filing a suit in a court of law to address an intellectual property infringement claim or pursue an enforcement action through the applicable federal, state, or local agency if that action is available. You agree that it must be brought in your individual capacity and not as a plaintiff or class member as part of a class action.

We reserve the right, at our sole discretion, to update, change, or replace any part of these Terms and Conditions by posting updates and changes to our website. It is your responsibility to check our website periodically for changes. Your continued use of, or access to, our website, or the Services or products offered, following the posting of any changes to these Terms of Service constitutes acceptance of those changes.
